MISHNAS V. AND VI. Everyone who is stoned is also hanged. This applies to a male, but not a female. Two people must not be judged on the same day if their crimes carry two different kinds of death penalties. How was one hanged? The beam was put into the earth, etc. King Sabur asked Rabbi Hama: "From where in the Torah do you deduce that one must be buried?" Is the burial because the corpse would be disgraced if left unburied, or is it for the sake of atonement? Is the mourning an honor for the living or for the deceased? And what is the difference? A wicked person must not be buried next to an upright one. All the curses with which David cursed Joab fell on the descendants of David. If not for Joab, David would not have been able to occupy himself with the law. . . . 139–148
MISHNAS I. TO V. Four kinds of capital punishment are prescribed to the court by the Scriptures. According to Rabbi Simeon, burning is more rigorous than stoning. In the case of a priest's daughter who commits adultery, burning applies; in the case of her father-in-law, stoning applies. How is this to be understood? Do you come to teach a Halakha (legal ruling) that will only be used when the Messiah appears? The prescribed punishment of burning was this: The sinner was placed in waste up to their knees. Then, a twisted scarf of coarse material was placed within a soft one, etc. But why should burning not be inferred from the offerings of the bullocks, which were burned bodily? Nadab said to Abihu: "When will the two old men die, so you and I can be leaders of Israel?" The prescribed punishment of slaying (beheading) was thus: The sinner was decapitated. The prescribed punishment of choking was thus: The sinner was placed in waste up to their knees, etc. Stoning applies to the following sinners: one who had relations with his mother, etc. “A man” is used to exclude a minor. [Leviticus 22]:
“That lies with his father’s wife”
means there is no difference whether she is his mother or not. . . . 150–164
MISHNAS VI. TO VII. One who had relations with a human male or with an animal, and also a human female who uncovers herself before a male animal, are punished with stoning. With an animal, it makes no difference whether it was large or small. A blasphemer is not guilty unless he mentioned the proper name of God (Jehovah). “Any man whatsoever,” etc., is meant to include the heathen, who are also warned against blasphemy.
