to confirm the Safe Conduct already obtained, as well as the special Protectorium; so that the Abbot may be able to act more freely in the way of Law against all the violence of the prepotent opposing party, and for the sake of his Office defend both himself and the Imperial Abbey entrusted to him with the incorporated Provostship of Saint Faith.
Lastly, to remove every subterfuge of the opposing party, and to lift also any critical doubt regarding the incompetence of the Imperial Forum in this case, it is notorious from the printed notices published to the whole world that the Abbot principally intended, still intends, and seeks, according to the Council of Trent, Session 25, Chapter 1 and Chapter 21, on Regulars, both to restore the collapsed Discipline in his own Monastery, and to stabilize for the future the collapsed Provostship of Saint Faith, restored by himself some years ago; but because by reason of both holy works he was impeded by the opposing party in various ways and by acts beyond measure violent, as was related above, therefore by most excellent Right approved by the Church herself, he recurs to the most August Emperor for obtaining strong assistance against any disturbers, as is expressed in the clearest words in the Tridentine Session just cited: The Holy Synod also exhorts all Kings, Princes, Republics, and Magistrates, and commands in virtue of Holy Obedience, that they may wish to interpose their aid and authority to the aforementioned Bishops, NB. Abbots and Generals and other Prefects in the execution of the Reformation contained above, as often as they shall be required, so that the aforesaid (namely, concerning the restoration of both regular Discipline and collapsed Provostships) may be rightly executed without any impediment to the praise of Almighty God. Behold, Holy Mother Church herself, in favor of regular Discipline (where it has collapsed) being restored, and for the divine worship in restoring collapsed Provostships being promoted, orders the Secular Arm to be implored, while she exhorts and commands that Secular Princes, in these cases, when required by the Rectors of Churches, interpose their authority; therefore, the same holds much more in the present case, where the Abbot, in executing the Council of Trent regarding the aforementioned, was moreover most injuriously despoiled of his total Abbatial Administration, not only regarding Spirituals but also regarding Temporals, contrary to the special Imperial Protection, from which, through these acts of violence, the Imperial Authority is deemed to be simultaneously most gravely violated; to which the Most Serene Lords Vicars of the Empire appear to have looked provisionally and justly; otherwise, they would certainly not have approved and published such favorable Conclusions for the petitioning Abbot, etc.
Wherefore it will also be most just that the Authority of the SAME, interposed in favor of administering Justice and promoting Divine Worship according to divine and human Laws, not be exposed so carelessly to public mockery, but always persist safe with its full effect:
Likewise, it is most equitable that the supreme Authority of both Charles VI and other of his most August predecessor Roman Emperors, pledged for the protection of the Abbot and the Abbey of Saint Michael, and publicly harmed in the aforementioned spoliatory acts, be restored anew, that all things be restored in full, and the damages inflicted be repaired.
Finally, it is most worthy and supremely necessary that the most Holy Tridentine Synod regarding the Constitutions in matters of Morals and the prescribed Reformation be faithfully executed, consequently that Regular Discipline in the Imperial Monastery of Saint Michael with the collapsed Provostship of Saint Faith be restored by Abbot Anselm, especially in these calamitous times, when greater care must be taken for appeasing God—who is angry—with pious works, whence he who conclusively infers from open divine and human Laws will offer nothing alien to the Laws; that the despoiled Abbot, with the similarly despoiled Provostship of Saint Faith, just as from the Holy See regarding Spirituals, so also by Imperial Authority regarding Temporals, must above all be restored in full and strongly protected against all further violence so that the work holy begun may be happily finished with God’s help, if not immediately, while the time is still so turbulent, in which it is said that laws are silent amid the clashing of iron, then at least the case will remain reserved to be resolved practically in the future:
