From chapter 1, section "Præterea", "De prohibita feudi alienatione" concerning the prohibition of the alienation of a fief, by Frederick in the V. F. referring to the Volumen Feudorum or Book of Fiefs, and the notes therein.
I.
It is established that fiefs of greater dignity, such as Duchies or Counties, cannot regularly be divided.
II.
Even if the co-owners confortes joint-heirs or partners in a fief strongly consent, as it seems to the Doctors.
III.
However, inferior fiefs having no annexed dignity accept division.
IV.
Even without the consent of the Lord, and thus without the danger of losing them.
V.
And we conclude that the consent of all who are co-owners is not required here, but that the consent of some is sufficient.
