Deservedly, therefore, the fiscus public treasury conquers the woman in competition.
LXXII.
The effect of this privilege, or right of priority, is threefold. The first regards acting: so that a prior creditor, even if others possess the thing or goods in which he has the right of mortgage, may nevertheless claim them from them.
LXXIII.
The second regards excepting: so that if he possesses the thing, and is summoned by others, he is protected by an exception.
LXXIIII.
The third, that if he has sold the pledge, the praetor magistrate protects the buyer against everyone.
